ConnectBy.com Terms of use and service

Please read and familiarize yourself with the following Terms and Service Agreement before using Connectby.Com and the networking and socializing services we freely provide whether accessed through our computer application or mobile application(s).

Privacy
Of the utmost importance to us is your privacy and enjoyment. To this end we do not request your identity. We do ask you to put your name which can be just a first name, a nickname, your initials, ect.. This is how the ConnectBy global Community will know you.
We require that you indicate which country you are located in or wish to be associated with by the ConnectBy global community. This will help the community to find you.
We do require your email address in order to verify that you do exist. We email you a verification email at the time you join the ConnectBy Global Community which is free and always will be. Your email address allows us to send you your notifications as per your settings of daily, bi-weekly, weekly or never. Your email is also necessary to retrieve your username or password should you forget either.
We ask, but do not require, that you provide your year of birth and gender for use in our ConnectBy Green List feature which allows you to find others globally by common interest and filter the results by language, country, age- hi and lo, and gender. This information is very useful in your experiencing all that ConnectBy has to offer. Some subjects are gender specific and, based on the interest, you may prefer to connect with others in a certain age bracket.
Neither your email address or year of birth is made known to any third parties, including other members or companies with which we do business.
To see what information ConnectBy has regarding your identity please view your settings page, and profile page. We have a list of your current interests as reflected in your current hot keys though we do not keep a record of your past interests. We do not track your location in any manner.

Managing Your Data
Under no circumstances do we share your data with third party individuals or companies for any reason unless by court order. Only you and ConnectBy have the ability to delete your posts, comments or account. Only one person at ConnectBy has the ability to view your email address. This persons is responsible for not sharing it with others.

Managing Your User Account
You have the ability to delete any of your posts or comments. You have the ability to either deactivate or delete your account.
Deactivating your user account- found in your settings page is the deactivate button which when selected will allow you a 30 day window to reactivate before your account is closed.
Deleting your user account- found in your settings page is the delete account button which when selected erases all of your account information making it un-retrievable by yourself or ConnectBy. This action deletes all of your posts, comments on other users posts, removes you from all lists including users following you, users your following, connections.

Sharing Your Content and Information
You own all of the content and information you post on ConnectBy.

1. For content that is covered by intellectual property rights, like photos and videos (IP content), you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on ConnectBy (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
3. When you publish content or information on ConnectBy, it means that you are allowing everyone, including people off of ConnectBy, to access and use that information, and to associate it with your ConnectBy persona (i.e., your name and profile picture).
4. We always appreciate your feedback or other suggestions about ConnectBy, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).

Keeping ConnectBy a secure place for the global community- To keep ConnectBy a place where peoples of all cultures feel comfortable, please adhere to the following rules. An infraction of these rules will result in your membership being terminated:

1. You will not post content that: is hateful towards others, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
2. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on ConnectBy
3. You will not bully, intimidate, or harass any user.
4. You will not post unauthorized commercial communications (such as spam) on ConnectBy.
5. You will not use ConnectBy to do anything unlawful, misleading, malicious, or discriminatory.
6. You will not facilitate or encourage any violations of this Statement or our policies.

Registration and Account Security

1. Providing the information required by ConnectBy does not create any risk regarding your security. We suggest that you exercise diligence regarding who you share your personal information with. Build connections with ConnectBy. Understand that building friends and the level of trust a friendship permits takes much longer than building connections.
2. If we disable your account, you will not create another one without our permission.
3. You will not use the activity line primarily for your own commercial gain.
4. You will not use ConnectBy if you are under 13.
5. You will not use ConnectBy if you are a convicted sex offender.
6. You will not share your ConnectBy login credentials.

Respect the ConnectBy Global Community

1. You will not post content or take any action on ConnectBy that infringes or violates someone else's rights or otherwise violates the law.
2. We can remove any content you post to ConnectBy if we deem it to be in violation of this statement or our policies.
3. If we deem your behavior inappropriate to maintaining a comfortable and respectful environment on ConnectBy we reserve the right to disable your account.

Mobile and other devices
While we provide our mobile versions free, your carrier's normal rates and fees, such as text messaging and data charges, will still apply.
You provide consent and all rights necessary to enable users to sync (including through an application) their devices with any information that is visible to them on ConnectBy.

Advertisements:
Our ConnectBy goal is to maintain an interesting environment to our Global ConnectBy Community in every respect. This includes interesting advertisements which are in sync with your interest keys. Our income source is "interest based targeted advertising".
We do not provide your email to advertisers in any form. To the ConnectBy Global Community and ConnectBy, your profile is what you post as being of interest. Your interests and views are you and .

Software Updates
If you download or use our software, such as a stand-alone software product, an app, or a browser plugin, you agree that from time to time, the software may download and install upgrades, updates and additional features from us in order to improve, enhance, and further develop the software.

Terms of Use Amendments:
We’ll notify you before we make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our Services.
Your continued use of the ConnectBy Service, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.
If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of the ConnectBy service to you. We will notify you by email or at the next time you attempt to access your account.
If anyone brings a claim against us related to your actions, content or information on ConnectBy, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on ConnectBy and are not responsible for the content or information users transmit or share on ConnectBy. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on ConnectBy. We are not responsible for the conduct, whether online or offline, of any user of ConnectBy
Through your act of completing the registration process for ConnectBy, you represent that you are 13 years of age or older, and can and will be legally bound by this Agreement. If you are a minor, your parent or guardian must read and accept the terms of this Agreement before you register. Members may not participate where doing so would be disallowed by any applicable law or regulation.

Member's use of the Connectby website or the Services signifies acknowledgment of and agreement to ConnectBy’s Privacy Policy. Members further acknowledge and agree that ConnectBy must and will disclose Member's information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to comply with legal process, enforce this Agreement, or to protect the rights, property, or personal safety of ConnectBy, its employees, users and third parties, and the public, or as otherwise described in the Privacy Policy.

B) information holding and storage
All information collected by ConnectBy through your use of the ConnectBy website will be stored by ConnectBy with the best intentions of it indefinitely being in a safe and secure manner.

C) Notice Regarding Commercial Email
You shall receive email messages from us in accordance with your settings which are extremely easy to find and manage.

D) Member Account and Password
After becoming a member of ConnectBy through this registration process, you will have a password and a username with a specific email which is used with ConnectBy (an account). As a member you are responsible for maintaining the confidentiality of your account. Your name, as provided to us by you, will of course show on all of your posts and comments and is the one part of your account which is open to all fellow members. Furthermore, as a member you are entirely responsible for any and all activities that occur under your member account and agree to immediately notify ConnectBy,com of any unauthorized use of Member's account or any other breach of security

E) Description of Service Proved by ConnectBy.com

1. Ability to build your profile through your likes, dislikes and comments.
2. View other members profiles though viewing there interests (likes, dislikes and comments)
3. Ability to comment on other members posts.
4. Personal messaging system for members, who are connections, to communicate with each other
5. Ability to build social groups facilitating interesting group discussions.
6. System by which members interests are analyzed and recommendations are made as to members you should find interesting through our user administered Green List Feature.

C) Member Conduct
Use of the Services by you, as Member, is subject to all applicable local, state, national and international laws and regulations. ConnectBy reserves the right, but does not assume any obligation, to monitor the Services to enforce this Agreement. ConnectBy reserves the right to terminate your access to and use of the Services if you are considered to be putting content on the site which fall into the following catagories.

1. Members shall not use any portion of the ConnectBy website or the Services to post, upload, email, transmit or otherwise making available content, including user names that is harmful, threatening, abusive, vulgar, obscene, profane, defamatory, libelous, hateful, or racially, ethnically or otherwise objectionable.
2. Members shall not use any portion of the CONNECTBY website or the Services to post, share, promote, depict, encourage, solicit or exchange illegal information.
3. Members shall not upload photos, graphics or other content that contain or promote illegal substances or activities, including, but not limited to, underage drinking or smoking, substance abuse, weapon use, or gang affiliation.
4. Members shall not post content that displays pornographic or sexually explicit material of any kind.
5. Members shall not provide material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
6. Members shall not use any portion of the ConnectBy website or the Services for any unlawful purpose.
7. Members shall not publicly post information that poses or creates a privacy or security risk to another person.

All judgments concerning the applicability of these guidelines shall be at the sole and exclusive discretion of ConnectBy. CONNECTBY has the right in its sole discretion to pre-screen, refuse or remove any content that is available via the ConnectBy. ConnectBy shall have the right to remove any content that violates this Agreement or is otherwise objectionable. An account may be terminated at any time, without notice , depending on the severity of the offense, which is determined exclusively at the discretion of CONNECTBY. CONNECTBY is not obligated to provide a Member with a warning prior to removal. Should Member object to any terms and conditions of the Agreement or any subsequent modifications thereto or become dissatisfied with ConnectBy in any way, Member's only recourse is to either/or : (1) discontinue use of ConnectBy; (2) terminate ConnectBy registration; and (3) ConnectBy of termination.

D. Modifications to Site
ConnectBy reserves the ability to change or amend this Agreement at any time, for any reason, or for no reason at all, at ConnectBy’s sole discretion. The most recent version of this Agreement will be posted on the ConnectBy website. Although ConnectBy will provide notice of material changes to this Agreement on the CONNECTBY website, as a Member it is your sole responsibility to keep yourself apprised of any such modifications or amendments. Should Member object to any terms and conditions of the Agreement or any subsequent modifications thereto or become dissatisfied with ConnectBy in any way, Member's only recourse is to immediately: (1) discontinue use of ConnectBy; (2) terminate ConnectBy registration; and (3) notify ConnectBy of termination.

E) Mobile
Services of ConnectBy through a mobile website and/or mobile application shall be governed by the same rules as the computer web based version. This Agreement governs all Services that are accessible on or through the Mobile Applications.

F. Patents, Intellectual Property Rights, Copyrights, and Trademarks
Member may not copy, reproduce, distribute, or create derivative works from the ConnectBy Content or third party Content without expressly being authorized to do so by ConnectBy or the third party advertiser. ConnectBy does not claim ownership of content that its Member's may provide to ConnectBy. By providing content to ConnectBy, Members understand that the content will be viewed by other ConnectBy members. ConnectBy respects copyright law and expects Members to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify ConnectBy at report@connectby.com.

G) Termination
Either party may terminate use of the ConnectBy website or the Services with or without cause at any time and effective immediately with or without notice to the other party. ConnectBy may terminate with or without cause at any time and effective immediately, at ConnectBy sole discretion, including but not limited to Member's failure to conform with these terms and conditions of the Agreement.

H) LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL CONNECTBY BE LIABLE ON ACCOUNT OF MEMBER'S USE OR MISUSE OF THE CONNECTBY WEBSITE OR THE SERVICES, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE CONNECTBY WEBSITE OR PRODUCTS ADVERTISED ON CONNECTBY.

I) HOLD HARMLESS
Member agrees to indemnify and hold CONNECTBY, its subsidiaries, affiliates, successors, assigns, directors, officers, agents, employees, service providers, and suppliers harmless from any dispute which may arise from a breach of terms of this Agreement. Member agrees to hold CONNECTBY harmless from any claims and expenses, including reasonable attorney's fees and court costs, related to Member's violation of this Agreement.

J) Governing Law
The Agreement and the relationship between Member and CONNECTBY shall be governed by and construed in accordance with the laws of the State of California, without regard to any conflict of law principles to the contrary.

R) Agreement
The Agreement constitutes the entire agreement between Member and CONNECTBY.

We try to keep connectby up, bug-free, and safe, but you use it at your own risk. We are providing connectby as is without any express or implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that connectby will always be safe, secure or error- free or that connectby will always function without disruptions, delays or imperfections. Connectby is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. If you are a california resident, you waive california civil code §1542, which says: a general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor. We will not be liable to you for any lost profits or other consequential, special, indirect, or incidental damages arising out of or in connection with this statement or connectby, even if we have been advised of the possibility of such damages. Our aggregate liability arising out of this statement or connectby will not exceed the greater of one hundred dollars ($100) or the amount you have paid us in the past twelve months. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, connectby's liability will be limited to the fullest extent permitted by applicable law.

Provision for users outside of the United States
You consent to having your personal data transferred to and processed in the United States.
If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on ConnectBy such as advertising. You will not use ConnectBy if you are prohibited from receiving services, or software originating from the United States.

Definition:
By "ConnectBy" we mean the features and services we make available, including through our website at www.ConnectBy.com and mobile versions.
By "content" we mean anything you or other users post, provide or share using ConnectBy.

1. By "data" or "user data" or "user's data" we mean any data, including a user's content or information that you or third parties can retrieve from ConnectBy or provide to ConnectBy through Platform.
2. By "post" we mean post on ConnectBy or otherwise make available by using ConnectBy.
3. By "use" we mean use, run, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
4. By "application" we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us. If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.
5. By "Trademarks" we mean the list of trademarks provided here.
